If you are visiting our site and want to become a member, please carefully read the following Terms of Use (Terms and Conditions) prior to registering as a Member of SistersByChoice.com. By completing your registration information, and clicking on the "I Accept" button (Terms of Use) below, you will become a registered Member of the SistersByChoice.com Service.
SistersByChoice.com reserves the right to update and/or change any of the following agreement provisions at any time. Should any revisions be made they will be posted on the SistersByChoice.com website. It is the Members responsibility to check in for updates and/or changes to either the Terms or Use(Terms and Conditions) and/or Privacy Policy. Any use of the SistersByChoice.com Service after notice on the website will result in acceptance by You of such changes.
These Terms of Use are a legally-binding Agreement for the provision of SistersByChoice.com between You and SistersByChoice.com. By registering and becoming a member of SistersByChoice.com You verify that You are over 18 years old and agree to abide by the following Service Agreement (referred herein as the “Terms Of Use”):
ARTICLE I : CONTRACT
Section 1.1 “We” agree to provide and maintain the SistersByChoice.com website. By registering and becoming a Member “You” agree to abide by these Terms of Use.
Section 1.2 You agree to provide us with name, email address, home address, and/or billing changes immediately upon effect. SistersByChoice.com takes no responsibility for subsequent loss of mail therein or any other Liability, and reserves the right to end SistersByChoice.com Membership if changes concur without notification.
Section 1.3 Your completed Profile will be displayed on SistersByChoice.com, and as a Member, You will be able to view the Profiles of other Members, and have the option to use the Service messaging, boards, and/or chat room to contact or be contacted by other Members. No personal identifying information will be posted. You are responsible for information You share with other Members in e-mails, messaging, forums, and chat rooms.
Section 1.4 You acknowledge that any details posted by You on SistersByChoice.com website will be able to be accessed by the Members.
Section 1.5 You are solely responsible for Your own interactions with other Members on SistersByChoice.com website Service. All Members have access to, and are encouraged to read and follow the “SAFETY TIPS” posted on SistersByChoice.com website in regards to meeting friends online.
Section 1.6 You shall be responsible for the accuracy of any information necessary for Us to perform SistersByChoice.com Service and for You and Your interactions on the site.
Section 1.7 Registering and becoming a member: (a) You are agreeing to receive notification e-mails related to your on-site message box, about your Profile status, log on activity and members who are interested in friendship with you and have added you to their favorites. (b) You are agreeing to receive, by e-mail, an official Sisters By Choice Membership card you may print.
Section 1.8 Members will be able to send and receive messages, view profiles, participate in forums and participate in Chat Room when We have received full payment for this Service.
Section 1.9 Your application for membership shall come into effect once We have received your Profile request, Acceptance or Terms of Use, and Correct Billing Information, and We notify You of Our acceptance of your membership by email as confirmation. This process takes between 12-24 hours.
Section 1.10 We reserve the right to monitor and remove, for any reason, any information, photographs and/or other material Posted by You, which is deemed unacceptable for the site.
Section 1.11 We reserve the right to refuse any application for membership.
Section 1.12 We reserve the right to change any of the Terms of Use of this agreement at any time, and in its sole discretion by posting changes on the SistersByChoice.com website. It is the Members responsibility to check in for updates and/or changes to either the Terms or Use(Terms and Conditions) and/or Privacy Policy. Any use of the SistersByChoice.com Service after notice on the website will result in acceptance by You of such changes.
Section 1.13 We reserve the right to make changes to SistersByChoice.com Service as deemed necessary or desirable.
Section 1.14 International Users: Accessing this site, and services, products or contents available on this site, except as expressly allowed through instructions and truthful statements by the User in regard to use of this site, from places outside the U.S. or where their contents are illegal, is prohibited. Those who choose to access this site from other locations do so knowingly on their own initiative and voluntarily at their own risk and are
responsible for compliance with local laws. None of the information on this site may be downloaded, exported or re-exported into Libya, Iraq, North
Korea, Cuba, the National Union for the Total Independence of Angola
(UNITA), Iran, Syria, Sudan, Burma (Myanmar), Serbia, the Taliban, Sierra
Leone, Liberia, designated Terrorists and international Narcotics
Traffickers, Foreign Terrorist Organizations, and/or designated foreign persons who have engaged in activities related to the proliferation of weapons of mass destruction or any other country with restrictions imposed by
the U.S. Government. By using this site, you agree that you are not a
citizen of or a resident in any of these countries.
ARTICE II : PAYMENT & PRICES
Section 2.1 The Membership fees for the SistersByChoice.com Service are shown under Sisters By Choice Membership Options or seen displayed on our friendship page. We reserve the right to vary these prices at any time.
Section 2.2 Our preferred method of payment is by credit/debit card. Payment is made by a secure server, which will encrypt Your transaction for Your security.
Section 2.3 Once paid, all Membership fees for SistersByChoice.com Service are non-refundable under any circumstances, as we have then started to provide our full service to you.
Section 2.4 You agree to be responsible in selecting which membership payment you wish to make, which is clearly displayed at our subscription page and confirmed throughout the payment process. We will not accept any liability in refunding any differences after you have selected and completed your payment.
Section 2.5 Membership to SistersByChoice.com Service shall not be accepted until We have received clearance of available funds and proper payment to the full amount outstanding.
Section 2.6 For International Members (members outside of the United States Of America), SistersByChoice.com will not be held responsible for exchange rate fluctuations.
ARTICLE III : TERMINATION
Section 3.1 If You decide to terminate this Agreement you can do so by either removing your account at 'Profile’ Options or by email to us. We will remove Your details from the site within 72 hours.
Section 3.2 SistersByChoice.com holds the right of termination of this Agreement, without notice, if You fail to make full payment when due, if the information that You provide is found to be untrue or if You breach the terms of this Agreement.
Section 3.3 If Our Internet provider reports that Your email address no longer exists then SistersByChoice.com may subsequently close Your account, resulting in loss of Your membership.
Section 3.4 SistersByChoice.com Service will immediately remove any Member who:
a) Makes a fraudulent payment
b) Uses, transmits, and/or sends inappropriate and/or offensive language or remarks.
c) Transmits and/or sends repeated contact messages with same content.
d) Uses our site to send spam messages
e) Uses our site for advertising or commercial use
f) Sends inappropriate and/or offensive messages and/or pictures that is likely to cause offense to another member. This includes messages and/or pictures containing discrimination related to color, creed, sexual orientation, age, disabilities and/or gender; sexually explicit material; material that is abusive and/or threatening.
ARTICLE IV : TRADEMARKS, COPYRIGHTS, AND PRIVACY
Section 4.1 You may not Reproduce any materials from SistersByChoice.com website without first obtaining the prior consent of the owner of such rights. This includes, but not limited to trademarks, copyrights, and any other written and/or picture information from the SistersByChoice.com website. All copyright and design rights are owned by SistersByChoice.com and are not available for use by any other party.
Section 4.2 You may not copy and upload another members photo or any photos of celebrities or someone who is not you, to your profile. Doing so will result in your profile being removed from the site.
Section 4.3 You may not transmit and/or Post any chain letter and/or junk e-mail to other Members; solicit other Members' business, buy or sell products and/or services through SistersByChoice.com. You may not use SistersByChoice.com to promote any other internet sites, services, and/or businesses in any way.
Section 4.4 You may not misuse SistersByChoice.com Service or any information Posted on SistersByChoice.com.
Section 4.5 You agree not to hold SistersByChoice.com liable for anything stated or messages received on the site’s e-mail, within the forums, and/or within the chat room(s).
Section 4.6 Your personal Profiles may not contain details of Your surname, home/work address, company name, email address, or telephone numbers. We recognize Our responsibilities under the Data Protection Act and We will keep Your personal details such as Your name, e-mail address confidential and will not disclose such information, except if required to be disclosed by law.
Section 4.7 Unauthorized users are not permitted on SistersByChoice.com.
Section 4.8 You agree that You are the only person authorized to use SistersByChoice.com Service. Your membership is non-transferrable.
Section 4.9 You agree to not send inappropriate and/or offensive messages and/or pictures that is likely to cause offense to another member. This includes messages and/or pictures containing discrimination related to color, creed, sexual orientation, age, disabilities and/or gender; sexually explicit material; material that is abusive and/or threatening. If you are a recipient or observer of this type of behavior, we encourage you to immediately report this to SistersByChoice.com and make report on the “Contact Us” Button.
Section 4.10 You agree not to contact us by email sending aggressive, disrespectful, impolite, vulgar, defamatory content or threats. Doing so your membership will be terminated immediately.
Section 4.11 We take no responsibility for any events organized through using our service.
ARTICLE V : GUARANTEE
Section 5.1 SistersByChoice.com is provided in its current form and We cannot guarantee that SistersByChoice.com Service, or any element of SistersByChoice.com will meet Your requirements, purpose and/or expectations.
Section 5.2 We do not provide any warranty in respect of the Service, results, availability, activity and/or uninterrupted use, if for any reason there is an interruption to Our server provider or if it should become necessary to move SistersByChoice.com Service to another server.
Section 5.3 While we take measures to ensure that all information and /or material provided by Us is accurate, We do not guarantee that this is the case.
ARTICLE VI : LIMITATIONS ON LIABILITY
Section 6.1 We accept no Liability to You arising out of Your use of SistersByChoice.com and/or Your reliance on any information and/or other material Posted on SistersByChoice.com or Posted to You by other Members.
Section 6.2 We accept no Liability to You arising out of any Member's and/or unauthorized user's misuse of information and/or other material Posted by You on SistersByChoice.com and/or to other Members.
Section 6.3 Under no circumstances whatsoever shall SistersByChoice.com be responsible or liable for any loss or damage of any kind whatsoever which You may suffer or incur directly or indirectly through the use of the SistersByChoice.com website.
Section 6.4 We accept no Liability for any defect in the Service caused or contributed to by You and/or any other Member.
Section 6.5 We accept no responsibility for false information disclosed or for the use of any information entered and used by "Hackers" or third parties.
Section 6.6 Nothing in this Agreement shall exclude or limit any of Your statutory rights.
ARTICLE VII : CAUSE BEYOND OUR REASONABLE CONTROL
We will not be liable or deemed to be in breach of contract by reason of delay or failure to perform any of Our obligations if this delay or failure was due to any cause beyond Our reasonable control.
ARTICLE VIII : INDEMNITY
You agree to indemnify Us against any and all losses, proceedings, lost profits, damages, awards, expenses, costs (including increased administration costs and legal costs on a full indemnity basis), claims, actions and any other losses and/or liabilities suffered by SistersByChoice.com and arising from and/or relating to Your use of SistersByChoice.com, information and/or other material Posted on SistersByChoice.com by You and/or arising from or due to any breach of contract, any tortuous act and/or omission and/or any breach of statutory duty by You.
ARTICLE IX : SISTERSBYCHOICE.COM ADVERTISERS and/or AFFILIATES
Affiliates are only given authority to offer product and services as advertised on the SistersByChoice.com website, and SistersByChoice.com is only responsible for fulfilling the services and products as advertised on SistersByChoice.com. Any additional services and products offered by the affiliate as part of a package, or in conjunction with a SistersByChoice.com service or product is the responsibility of the affiliate to provide.
EXHIBIT A : DEFINITIONS
In these Terms of Use, the following words have the following meanings unless the context requires otherwise:
"AGREEMENT" means the Agreement between You and Us incorporating these Terms of Use (Terms and Conditions) for the provision of the SistersByChoice.com Service;
"LIABILITY" means Liability for any and all damages, claims, proceedings, actions, awards, expenses, costs and any other losses and/or liabilities;
"MEMBER" means any person who has registered and certified that she/he has read and understands and agrees with the specific Terms of Use (Terms and Conditions) and the general intent thereof, makes use of the Service and/or browses the information and/or material contained in the Service;
“POST” means display, exhibit, publish, distribute, transmit and/or disclose information, details and/or other material on the Service, and the phrases "Posted" and "Posting" shall be construed accordingly;
“PROFILE means the section containing details and/or information about You composed and Posted by You;
“SERVICE” means the SistersByChoice.com website Service provided by Us to You;
“TERMS OF USE” means the Agreement between You and Us; also referred to as Terms and Conditions for the provision of the SistersByChoice.com Service.
“WE, US, OUR” means SistersByChoice.com;
"YOU, YOUR, YOURSELF" means the person whose application for membership of the Service is accepted by Us.
